Joint Plan Commission Meeting & Town Board Meeting Minutes
Monday, February 23rd, 2009

The Town of Dodgeville Plan Commission and Town Board met on Monday, February 23rd, 2009 at 6:30 PM. Chair, Dave Blume called the Joint Planning Commission & Town Board meeting to order at 6:34 PM.

Plan Commission Committee members in attendance were: Chair, Dave Blume, Laura Jean Blotz, Curt Peterson, and Larry Lenox. Absent members were: Matt Chitwood, John Crook and Greg Jewell.

Town Board members in attendance were: Chair, Curt Peterson, David Gollon, David Thomas and Charles Price. Absent members were: Greg Jewell.

Others in attendance were: Clerk/Treasurer Sara Olson, Terry Reed, Rick Terrien, Larry Forseth, Gordie Kramer, Larry Ruff, Sharon McGann and John Naughton.

Chairman Blume verified that proper notice of the meeting was posted on February 17, 2009 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. Larry Lenox made a motion to approve the public notice and agenda. Laura Jean Blotz seconded the motion. Motion carried.

Laura Jean Blotz made a motion to approve the January 26th, 2009 meeting minutes as submitted. Larry Lenox seconded the motion. Motion carried.

Rick Terrien from the Iowa County Economic Development Corporation introduced himself to the Plan Commission Board and the Town Board. Rick also commented on what his current focuses are for Iowa County.

Chairman Blume asked Gordie Kramer and Larry Ruff who were representing their business, Dodgeville Warehousers, in the current conditional use of property application to explain the current application. Gordie Kramer indicated to the Plan Commission that he was trying to change the conditional use of the property located at 4811 Curtis Road, being in part of the SW1/4 of the NW1/4 of Section 26-T6N-R3E from automotive sales/storage, service storage warehouse to implement dealer for sales, service and parts. Gordie Kramer also indicated to the members that Ziegler, Inc. would be leasing the building and intends to rent, sell, and service ag tractors, combines, sprayers and other related ag equipment and ag parts. Ziegler would employ a minimum of five full-time personnel from the area at the facility in year one, moving toward ten people within five years. Their hours of operation will be Monday thru Friday 7:00 a.m. till 5:00 p.m. and Saturday’s 7:00 a.m. till 12:00 p.m.

Larry Forseth from the City of Dodgeville fire department was questioning if there was a preference on the location of the above ground storage tank that is required by the state. Fire chief Larry Forseth also stated that there is sufficient fire protection. The Planning Commission and Town Board stated that the above ground storage tanks are state regulated and the state would have specifications on the location. Sharon McGann also commented that she didn’t have an issue with the petition as an adjoining land owner as long as the implement dealer kept old equipment on their own property.

Larry Lenox made a motion to approve the conditional use change from automotive sales/storage, service storage warehouse to implement dealer for sales, service and parts with the provision that the focused lighting must be approved by the Town of Dodgeville Plan Commission and all junk equipment must be placed in a visual screened fenced area out of the vision of the general public. Laura Jean Blotz seconded the motion. Motion carried.

Charles Price made a motion to approve the Planning Commission recommendation. David Gollon seconded the motion. Motion carried.

Chairman Blume asked Terry Reed who was representing himself in the current petition to explain the current petition. Terry Reed indicated to the Plan Commission that he was trying to rezone 5 acres more or less which contains the existing home from A-1 Ag to AR-1 Ag Residential for the purpose of making the parcel conforming. The petition was to rezone 5 acres more or less which contains the existing home for A-1 Ag to AR-1 Ag Residential being in part of the SW/SE of S7-T6N-R4E in the Town of Dodgeville. Terry Reed also explained to the Town Board that a separate tax parcel was produced based off of a mortgage deed to these 5 acres more or less until 1995 when the county began its computerized parcel mapping and noticed the error. A recorded mortgage deed does not legally divide the property and therefore it was corrected by eliminating the 5 acre lot. Terry Reed felt as if this parcel has always been treated as a 5 acre parcel and should remain the same.

The Town Planning Commission discussed in great detail Section H, Land Use Element, Agriculture and Open Space Areas, Item #10 and the exceptions. Larry Lenox from the Plan Commission felt as if a legal opinion was needed before a decision should be made on the application for clarification purposes on the Town of Dodgeville’s Comprehensive Plan as well as this petition will be setting a precedence for when other errors arise.

Clerk Sara Olson also presented the Plan Commission and the Town Board a letter received from Foley & Lardner LLP signed by Michael Van Sicklen in reference to their objection for these two rezoning applications.

Curt Peterson made a motion to continue this petition after seeking legal advice in reference to the Town of Dodgeville’s Comprehensive Plan. Laura Jean Blotz seconded the motion. Motion carried.

David Thomas made a motion to approve the Plan Commission recommendation and seek legal advice from an attorney in reference to the Town of Dodgeville’s Comprehensive Plan. David Gollon seconded the motion. Motion carried.

Chairman Blume asked Terry Reed who was representing himself in the current petition to explain the current petition. Terry Reed indicated to the Plan Commission that he was trying to rezone 8.780 acres from A-1 Ag to AR-1 Ag Residential for the purpose of making the parcel conforming. The petition was to rezone 8.780 acres from A-1 Ag to AR-1 Ag Residential being in part of the SW/SE of S7-T6N-R4E in the Town of Dodgeville.
Terry Reed explained that this parcel contains a cabin and is currently considered a non-conforming parcel and is requesting the rezone so that it will become a conforming parcel.

The Plan Commission discussed the Comprehensive Plan and the current petition and determined that it was an acceptable request due to a Certified Survey Map that already exists and is recorded with the Register of Deeds as well as it follows the plan.

Larry Lenox made a motion to approve the rezoning request to rezone 8.780 acres from A-1 Ag to AR-1 Ag Residential due to a Certified Survey Map already exists and is recorded with the Register of Deeds as well as this petition follows the plan. Laura Jean Blotz seconded the motion. Motion carried.

David Gollon made a motion to approve the rezoning request to rezone 8.780 acres from A-1 Ag to AR-1 Ag Residential as recommended by the Plan Commission. David Thomas seconded the motion. Motion carried.

Laura Jean Blotz made a motion to adjourn the meeting at 9:06 p.m. Larry Lenox seconded the motion. Motion carried.
