Sanitary District #1 & #2 Board of Commissioners
Monday, August 17th, 2015
*6:00 p.m.*
1) Call to order. Town Chairman, Curt Peterson called the meeting to order at 6:01 p.m.

Town Supervisors in attendance were David Gollon, Peter Vanderloo, David Blume and Steven Johnson via (speaker phone). Also in attendance were Clerk Sara Olson, Cory Berg, Ken Wallace and Greg Lee.

2) Approval of Public Notice/Agenda. Supervisor, David Gollon made a motion to approve the public notice and agenda seconded by Supervisor Steven Johnson. Motion carried.

David Blume made a motion to suspend the agenda and move to Item #8 Sanitary District #1 and City of Dodgeville Agreement. Peter Vanderloo seconded the motion. Motion carried.

3) Discussion & possible action re: Sanitary District #1 and City of Dodgeville Agreement. Clerk/Treasurer Sara Olson had indicated that she had obtained a copy of the City’s ordinance and indicated that Greg Lee felt Sections 13.24 to 13.40 should be incorporated into the agreement. Clerk/Treasurer Sara Olson had indicated that she is currently working with Greg Lee on obtaining copies of all the agreements and amendments.

4) Discussion & possible action re: Sanitary District #1 Requested Boundary Change & Sewer Allocation (Quality Liquid Feeds). The Board of Commissioners discussed the requested boundary change and sewer allocation for Quality Liquid Feeds with Ken Wallace and Cory Berg. The Board of Commissioners had indicated that Quality Liquid Feeds would need to have a surveyor modify the existing legal description of the Sanitary District to include this piece of property in which would be added to the Sanitary District. The Board of Commissioners discussed and had questions in regards to the current allotment breakdown for each property that is currently in the Sanitary District. The Board of Commissioner indicated that they had many question in regards to the transfer of allotment, the approval of the boundary change as well as who has authority to conduct the transfer and indicated that the Board of Commissioner will need to seek an attorney to figure out this information. Cory Berg had indicated that he would be willing to take this requested allotment of 1,200 gallons a day from the property in which he owns at 3625 State Road 23 due to it is currently vacant and they would like to be able to move forward with the planned addition. David Blume made a motion to allow the reallocation of the 3% entitled to Quality Liquid Feeds. David Gollon seconded the motion. Motion carried. The Board of Commissioners requested that Cory Berg draft a letter indicating the transferring of the sewer allocation.

5) Discussion & possible action re: Sanitary District #1 of the Town of Dodgeville Sanitary Sewer User Agreement between Sanitary District #1 and Quality Liquid Feeds. Clerk/Treasurer Sara Olson had indicated that the existing sewer user agreement will need to be modified to reflect the changes in allocation as well as the modifications to the legal description to include the home on the existing property after obtaining the requested documents for Quality Liquid Feeds. The Board of Commissioners had indicated that they didn’t want to hold up the construction process of the addition of Quality Liquid Feeds while trying to straighten everything out in regards to the boundary change of the Sanitary District as well as the reallocation of the allotment. Clerk/Treasurer Sara Olson had indicated that the Town’s rezoning approval had the conditions that all Sanitary District agreements, allocation of usage, boundaries and documents are amended to include the newly created lot. The Iowa County Planning Commission put the following condition on their recommendation as well: All sanitary district agreements, allocation of usage, boundaries and documents are amended to include the newly created lot to the satisfaction of the Town of Dodgeville. David Gollon made a motion to recommend to the Town Board that all sanitary district agreements, allocation of usage, boundaries and documents are amended to include the newly created lot to the satisfaction of the Town of Dodgeville. Steven Johnson seconded the motion. Motion carried.

6) Approval of Meeting Minutes from August 4th, 2015. David Gollon made a motion to approve the August 4th, 2015 meeting minutes as submitted. Peter Vanderloo seconded the motion. Motion carried. David Blume abstained.


7) Discussion & possible action re: Sanitary District #2 Greater Heights Annexiation. Town Board Chairman, Curt Peterson had indicated that the attorney had recommended the Township go into Closed Session to discuss this agenda item.

8) Closed Session in accordance with Wisconsin Statue 19.85 (1) (e) for deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. Steven Johnson seconded the motion. Motion carried. Roll Call: Peterson, yes; Gollon, yes; Blume, yes; Vanderloo, yes and Johnson, yes. Clerk/Treasurer Sara Olson was also present.

9) Reconvening into Open Session. Peter Vanderloo made a motion to reconvene into open session. Steven Johnson seconded the motion. Motion carried.

10) Board action as a result of Closed Session. David Gollon made a motion to follow the advice of the attorney with a letter being sent to the DOA in regards to the boundary agreement and not meeting the notice requirement for attachment. Peter Vanderloo seconded the motion. Motion carried. The Town Board explained the motion to Greg Lee who was present and indicated their concerns in regards to the timeline and had indicated that they would take the DOA’s advice in regards to the current situation.

11) Public Comment. None.

12) Adjournment. David Gollon made a motion to adjourn the meeting at 7:37 p.m. David Blume seconded the motion. Motion carried.
