Sanitary District #3 Board of Commissioners

*Immediately following the Regular Town Board Meeting*

1) Call to order. Town Chairman, Curt Peterson called the meeting to order at 7:23 p.m.

Town Supervisors in attendance were David Blume, David Gollon and Charlie Price. Absent was David Thomas. Also in attendance were Clerk Sara Olson and Jamie Ammann.

2) Approval of Public Notice/Agenda. Supervisor, David Blume made a motion to approve the public notice and agenda seconded by Supervisor David Gollon. Motion carried.

3) Approval of Meeting Minutes from November 9th, 2010. David Gollon made a motion to approve the November 9th, 2010 minutes as submitted. Charlie Price seconded the motion. Motion carried. David Blume abstained from the motion.

4) Discussion & possible action re: Past due invoice for waterleak in Sanitary District #3 (D.A. Auto). Jamie Ammann from D.A. Auto was present and talked to the Town Board about possible payment options and the possibility to delay annexation for one year.

5) Closed Session in Accordance with Wisconsin Statue 19.85 (1) (g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which is or is likely to become involved. David Gollon made a motion to go into closed session in Accordance with Wisconsin Statue 19.85 (1) (g) to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which is or is likely to become involved. Charlie Price seconded the motion. Motion carried. Roll call: Peterson, yes; Gollon, yes; Price, yes; and Blume, yes. Clerk/Treasurer Sara Olson was also present during closed session.

6) Reconvene into Open Session. David Gollon made a motion to reconvene into open session. Charlie Price seconded the motion. Motion carried.

7) Board Action as a Result of Closed Session. David Blume made a motion to allow Clerk/Treasurer Sara Olson to work out a payment plan with D.A. Auto for the unpaid invoice. David Gollon seconded the motion. Motion carried. David Gollon made a motion that any unpaid balance as of November 1st will be put on as a special charge on the real estate taxes. Charlie Price seconded the motion. Motion carried. David Gollon made a motion to charge monthly interest in the amount of 1% on any delinquent invoices in Sanitary District #3. Charlie Price seconded the motion. Motion carried.

8) Public Comment. None.

9) Adjournment. David Gollon made a motion to adjourn the meeting. David Blume seconded the motion. Motion carried.
