Plan Commission Meeting
Monday, March 30th, 2009

The Town of Dodgeville Plan Commission met on Monday, March 30th, 2009 at 6:31 PM. Chair, Dave Blume called the Planning Commission meeting to order at 6:31 PM.

Plan Commission Committee members in attendance were: Chair, Dave Blume, Laura Jean Blotz, Curt Peterson, Matt Chitwood, John Crook, Greg Jewell and Larry Lenox.

Others in attendance were: Clerk/Treasurer Sara Olson, Terry Reed, and Bob Butler. Terry Reed and Bob Butler were not present until 6:53 when the Town Planning Commission reconvened into open session.

Chairman Blume verified that proper notice of the meeting was posted on March 23, 2009 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. Curt Peterson made a motion to approve the public notice and agenda. Greg Jewell seconded the motion. Motion carried.

Laura Jean Blotz made a motion to approve the February 23, 2009 meeting minutes as submitted. Curt Peterson seconded the motion. Motion carried. Greg Jewell and John Crook abstained as they were not in attendance at the February 23rd meeting.

The Plan Commission went into Closed Session in Accordance with Wisconsin Statue 19.85 (1) (g) to confer with legal counsel for the governmental body who is rending oral or written advice concerning strategy to be adopted by the body with respect to litigation in which is or is likely to become involved. Curt Peterson made a motion at 6:38 to go into Closed Session in Accordance with Wisconsin Statue 19.85 (1) (g) to confer with legal counsel for the governmental body who is rending oral or written advice concerning strategy to be adopted by the body with respect to litigation in which is or is likely to become involved. Greg Jewell seconded the motion. Motion carried. Roll call: Peterson, yes, Blume, yes, Blotz, yes, Jewell, yes, Chitwood, yes, Lenox, yes, Crook, yes.

Curt Peterson made a motion to reconvene into open session at 6:53 p.m. Larry Lenox seconded the motion. Motion carried.

No action was taken on the closed session topic.

Chairman Blume asked Terry Reed who was representing himself in the current petition to explain the current petition due to a few members who were not in attendance at the last meeting where the topic was discussed. Terry Reed indicated to the Plan Commission that he was trying to rezone 5 acres more or less which contains the existing home from A-1 Ag to AR-1 Ag Residential for the purpose of making the parcel conforming. The petition was to rezone 5 acres more or less which contains the existing home from A-1 Ag to AR-1 Ag Residential being in part of the SW/SE of S7-T6N-R4E in the Town of Dodgeville.

Curt Peterson made a motion to recommend the approval of the rezoning of the 5 acres more or less which contains the existing home from A-1 Ag to AR-1 Ag Residential being in part of the SW/SE of S7-T6N-R4E with the remaining required acreage being put into the conservancy district or overlay district. This petition expires one year from the Town Boards recommendation to the Iowa County Planning & Development committee. Matthew Chitwood seconded the motion. Motion carried.

The Planning Commission members discussed prior applications that have non-compliant deed restrictions that have not been recorded with the Register of Deeds. John Crook made a motion to recommend to the Town Board that we provide a copy of these non-compliant deed restrictions to Scott Godfrey at Iowa County Planning and Development. This record would be placed in their records to put the general public on alert of the unrecorded deed restriction. Where applicable the Planning Commission may recommend a conditional approval on rezoning petitions pursuant to the recording of the deed restriction. A copy of the recorded document shall be given to the Town Clerk/Treasurer to be placed in their file at the town hall. Laura Jean Blotz seconded the motion. Motion carried.

The Planning Commission reviewed and discussed Section D, Utilities and Community Facilities of the Town of Dodgeville Comprehensive Plan.

John Crook made a motion to adjourn at 8:00 p.m. Laura Jean Blotz seconded the motion. Motion carried.
