Plan Commission Meeting
Monday, March 29th, 2021

The Town of Dodgeville Plan Commission met on Monday, March 29th at 6:00 P.M. Planning Commission Chair Larry Nelson called the Planning Commission meeting to order at 6:00 P.M.

Plan Commission Committee members in attendance were: Larry Nelson, Peter Vanderloo, Curt Peterson, Pam Johnson-Loy, Krista Dolan and Mary Wilson. Absent was Paul Lawinger.

Others in attendance: Kevin Unbehaun, Katie Cleary, Daniel Gollon, David Johnson, Kristin Barr and Daniel Barr.

Planning Commission Chairman Larry Nelson verified that proper notice of the public hearing was posted on March 19, 2021 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Pleasant Ridge Store, Mueller Implement and the Town Office. Curt Peterson made a motion to approve the public notice and agenda. Pam Johnson-Loy seconded the motion. Motion carried.

Krista Dolan made a motion to approve the August 31st, 2020 Plan Commission meeting minutes as presented. Pam Johnson-Loy seconded the motion. Motion carried.

The Planning Commission, David Johnson, Kristin Barr and Dan Barr discussed in detail the presented information for the rezoning applications of 5 acres more or less from A-1 and B-2 to RB-1 with the conditional use application for the operation of a horse stable, the rezoning application of 2 acres more or less from A-1 & B-2 to B-2 with the conditional use application for the purpose of considering operation of an existing mineral museum and gift shop as well as the rezoning of 15 acres more or less from A-1 and B-2 to AR-1 with the conditional use application to allow up to 12 animal units all land is located in Section 4, Town 6 North, Range 3 East.

1. Peter Vanderloo made a motion to recommend the approval of the rezoning application to rezone 5 acres more or less from A-1 and B-2 to RB-1 located in part of the NW ¼ of the SE ¼ lying west of Hwy 23, part of the SW ¼ of the SE ¼, part of the SE ¼ of the SW ¼, and the NE ¼ of the SW ¼ of Section 4, Town 6 North, Range 3 East located at 4228 State Road 23 with the conditional use application for the operation of a horse stable with the following conditions:
a. All building are or are built in compliance with all state codes.
b. The number of allowed combined animal units on the 5 acres rezoned to RB-1 and the 15 acres rezoned to AR-1 will not exceed 12.
c. The property owner of the parcel that contains the existing horse stable shall submit a current copy of a lease agreement with an adjoining landowner allowing the horse husbandry use of the adjacent property that provides adequate acreage to accommodate 12 animal units. The property owner must notify the Iowa County Office of Planning & Development of any changes with the agreement on file. If the lease is terminated at any time or not renewed, the conditional use permit will terminate.

Krista Dolan seconded the motion. Motion carried.

2. Curt Peterson made a motion to recommend the approval of the rezoning application to rezone 2 acres more or less from A-1 and B-2 to B-2 located in part of the SW ¼ of the SE ¼ and part of the SE ¼ of the SW ¼ of Section 4, Town 6 North, Range 3 East located at 4228 State Road 23 with the conditional use application for the purpose of operating an existing mineral museum and gift shop. Peter Vanderloo seconded the motion. Motion carried.

3. Peter Vanderloo made a motion to recommend the approval of the rezoning application to rezone 15 acres more or less from A-1 and B-2 to AR-1 located in part of the SE ¼ of the SW ¼ and the NE ¼ of the SW ¼ of Section 4, Town 6 North, Range 3 East with the conditional use application to allow up to 12 animal units with the following conditions:
a. The number of allowed combined animal units on the 5 acres rezoned to RB-1 and the 15 acres rezoned to AR-1 will not exceed 12.
b. The property owner of the parcel that contains the existing horse stable and the 15 acres rezoned to AR-1 shall submit a current copy of a lease agreement with an adjoining landowner allowing the horse husbandry use of the adjacent property that provides adequate acreage to accommodate 12 animal units. The property owner must notify the Iowa County Office of Planning & Development of any changes with the agreement on file. If the lease is terminated at any time or not renewed, the conditional use permit will terminate.
c. The appropriate acreage must be placed into the conservancy district to meet the Town of Dodgeville density standard.
The Planning Commission, Daniel Gollon and Katie Cleary discussed the rezoning application of David & Tim Gollon to rezone 10 acres more or less from AB-1 to RB-1 located in the SW ¼ of the SW ¼ of Section 35, Town 6 North, Range 3 East located on Brennan Road with the conditional use application for the purpose of considering a horse stable with an associated residence. The petitioners discussed there plans for the 10 acre parcel as well as the remaining 70 acres in which they would be utilizing to graze/corral up to 120 additional horses on the property for retail sale. The Planning Commission had requested for the petition to have a draft of the plan on the 10 acres to present to the Town Board.

Curt Peterson made a motion to recommend the approval of the rezoning application of David & Tim Gollon to rezone 10 acres more or less from AB-1 to RB-1 located in the SW ¼ of the SW ¼ of Section 35, Town 6 North, Range 3 East located on Brennan Road with the conditional use application for a horse stable, retail shop, a residence associated with the business and the retail of horses with the following conditions:

a. The number of allowed animal units on the 10 acres rezoned to RB-1 will not exceed 15 for boarding purposes.
b. The property owner of this parcel shall submit a current copy of a lease agreement with an adjoining landowner allowing the horse husbandry use of the adjacent property that provides adequate acreage to accommodate 15 animal units. The property owner must notify the Iowa County Office of Planning & Development of any changes with the agreement on file. If the lease is terminated at any time or not renewed, the conditional use permit will terminate.
c. After dark all sale horses would be viewed indoors to allow for adequate lighting.

Pam Johnson-Loy seconded the motion. Motion carried. Peter Vanderloo abstained from the motion.

Planning Commission Chairman, Larry Nelson talked about the benefits of having a topographical map available for the rezoning applications.

Krista Dolan made a motion to adjourn the meeting at 7:48 p.m. Mary Wilson seconded the motion. Motion carried.
