Plan Commission Meeting
Monday, August 31, 2009

The Town of Dodgeville Plan Commission met on Monday, August 31, 2009 at 6:30 PM. Chair, Dave Blume called the Planning Commission meeting to order at 6:30 PM.

Plan Commission Committee members in attendance were: Chair, Dave Blume, Laura Jean Blotz, Curt Peterson, Matt Chitwood, David Thomas, and Larry Lenox. John Crook was absent.

Others in attendance were: Clerk/Treasurer Sara Olson, Debi Morton, Betsy D’Angelo, Diane O’Donnell, Greg Klusendorf, Jim Griffiths, John Naughton, Dean Gullickson & Bob Butler.

Chairman Blume verified that proper notice of the meeting was posted on August 18, 2009 in accordance to WI Statutes 19.84 (3) at the Town Message Boards at Jumping Jupiter, Mueller Implement and the Town Office. Larry Lenox made a motion to approve the public notice and agenda. Laura Jean Blotz seconded the motion. Motion carried.

Curt Peterson made a motion to approve the June 29th, 2009 meeting minutes as submitted. Matt Chitwood seconded the motion. David Thomas abstained from this motion. Motion carried.

Chairman Blume asked Gregory Klusendorf who was representing himself in the current petition to explain the current petition. Gregory Klusendorf indicated to the Plan Commission that he was trying to rezone 4.85 acres more or less from A-1 Ag to AR-1 Ag Residential for the purpose of creating a conforming lot prior to possible selling the property. The petition was to rezone 4.85 acres more or less from A-1 Ag to AR-1 Ag Residential being in part of the SW/SW of S32-T7N-R4E in the Town of Dodgeville.

Curt Peterson made a motion to recommend the approval of the rezoning of 4.85 acres more or less from A-1 Ag to AR-1 Ag Residential being in part of the SW/SW of S32-T7N-R4E. Matthew Chitwood seconded the motion. Motion carried.

Curt Peterson explained the following situation to the Planning Commission: A individual owns approximately 91.43 acres more or less and currently has two homes on this property that were built before the adoption of the comprehensive plan, our current density standard is 1 residence per 35 acres, therefore is there a way that this individual could obtain or use someone else’s development rights so they have enough acreage to obtain a 3rd building site. The Plan Commission and general public commented on this issue and had several questions including the following: (1) Can an individual transfer their development rights to another individual? (2) What if the land is contiguous in another township beyond our jurisdiction? (3) Does the land have to be contiguous?

David Thomas made a motion to recommend the Town Board seek a legal opinion in reference to the current language in the Comprehensive Plan to see if the Comprehensive plan allows for the following: (1) Can an individual transfer their development rights to another individual? (2) What if the land is contiguous in another township beyond our jurisdiction? (3) Does the land have to be contiguous? Matt Chitwood seconded the motion. Motion carried.

The Plan Commission and general public discussed the negatives and positives of the possibility of establishing a Cluster Housing Ordinance. Clerk/Treasurer Sara Olson presented information in reference to Iowa County’s current ordinance in reference to Cluster Housing. Many members of the Plan Commission indicated that they didn’t feel there is a true need at this point to develop a Cluster Housing Ordinance as there could be changes within the next few months in reference to the State Budget passing the revisions to farmland preservation, as well as the decline in development and economy. Many people from the public had questions in reference to if the Planning Commission had ideas in reference to what they envisioned as Cluster Housing and some of the specifics. The Planning Commission indicated that they had done some work in the past in reference to Cluster Housing and will locate the files for the next meeting.

Matt Chitwood made a motion to continue the discussion of establishing a Cluster Housing Ordinance at the next Planning Commission meeting held on September 28th, 2009. Larry Lenox seconded the motion. Motion carried.

Laura Jean Blotz made a motion to adjourn the meeting. Matt Chitwood seconded the motion. Motion carried.
